By Phlebas Go To PostI'm regards to this his powers are far reaching in this situation. Doubt the Supreme Court touches this. That law was overturned by congress in 1965:
But the president ignores the fact that Congress then restricted this power in 1965, stating plainly that no person could be “discriminated against in the issuance of an immigrant visa because of the person’s race, sex, nationality, place of birth or place of residence.” The only exceptions are those provided for by Congress (such as the preference for Cuban asylum seekers).
While courts rarely interfere in immigration matters, they have affirmed the discrimination ban. In the 1990s, for example, the government created a policy that required Vietnamese who had fled to Hong Kong to return to Vietnam if they wanted to apply for United States immigrant visas, while it allowed applicants from other countries to apply for visas wherever they wanted. A federal appeals court blocked the policy.
The government in that case did not even bother arguing that the 1952 law permitted discrimination. The court rejected its defense that a “rational link” with a temporary foreign policy measure could justify ignoring the law — an argument the Trump administration is sure to make. The court wrote, “We cannot rewrite a statutory provision which by its own terms provides no exceptions or qualifications.”

Applying for H1B visas for foreign staff and their families to relocate to the US is one of the things I did for Catholic Relief Services for seven years. It's a lengthy and expense process that involves immigration attorneys and a boatload of paperwork. The process takes anywhere from three to five months to complete and costs $7-15k dollars in legal and application fees depending on how complex the position and the number of family members. You can only apply during a specific window and the cap is currently 65,000 applicants per year. Those are all gone within about ten days, so timing is everything because you're petitioning for these things against fortune 500 companies and there's no guarantee.
I probably oversaw applications for thirty or so families and never had one denied, but that's because we used top attorneys. The money and outlet (in my case, the international humanitarian arm of the Catholic Church) matter. I can't directly confirm anything, but having visited the State Department numerous times there's no way that favors aren't being handed out for visa preference.
None of that seems to matter now and people are being instructed to not even board planes to the US if you hold a passport for the countries that have been blacklisted. Other nations in the region are also being targeted and people are seemingly being profiled in mass.
Bannon has won for now, but this is just going to incite someone to do something stupid and then the real fun begins.

Oh wow GQ, that's how my family made it through via Catholic Charities after a long and lengthy interview process via the UN back in the late 90s.
By reilo Go To Post"Their views on TRUMP"? wtfApparently the border officials werent happy about it either. It's probably an order from high up.
I dont want this to be true for you guys but the tweets really seems legit.
Apparently Canada's Immigration Minister probably won't be allowed in the US since he's a Somali immigrant.
What a country we live in.
But economic anxiety tho.

And this affects thousands of travellers around the world who wants nothing to do with the United States.
With one stroke of the pen, Donald Trump has destroyed the credibility of this nation worked for nearly 8 decades to build.
Got a little teary reading that.
Meanwhile, our leader holds his hand, verbally sucks him off, refuses to condemn him and then makes deals with Erdogan. Fucking coward.

I understand that making a proper response to this might take days but heres hoping Trump is hit with a few dozen lawsuits from the get go.
The various tweets about this nonsense is one thing.
The responses to those tweets from openly racist people, like, literally white nationalist, is alarming.
They're feeling more empowered than ever right now and if a room full of FEDs aren't fully monitoring a few of these pieces of shit, then we're really failing domestically to protect citizens.
edit: Dual citizens
Imaging having to tell someone holding a US passport that they can't go home. How much does that person make? All you can do is laugh right now.

The ban also applies to citizens of counties not on the list, but born in countries on the list.
So I have a British passport but was born in Mogadishu. Denied.

Does not apply to US citizens with dual passports. Yet.
She broke her tweet thread around #12 so you have to go to her feed for the rest, but again, so many incredible and human stories about to be snuffed out by this odious administration.
By Phlebas Go To PostObama banned all Iraqi refugees for 6 months in 2011, no one seems to remember that though. It was tough googling that to find more information on the ban, because the first two pages are mostly alt right articles.

However, if you take your time and read it appears he paused the programme due to security issues regarding the refugee system.
It's different than the executive order Trump gave, by a huge margin.
O somebody raised a good point.
Luol Deng is a UK citizen who's from Sudan. Have the Lakers already played Toronto in Toronto this year? Cuz if not, he won't be able to go and come back.

Not as great as yours
Trump bans a bunch of Muslims and your first thought is to go find evidence of Obama doing it too. Fucking embarrassing.
By n8 dogg Go To PostNot as great as yoursPointing out the hypocrisy about the refugee ban and people finally giving it attention. Saw none of it when he did it.

But sorry I didn't suck Obama's dick
Hypocrisy? Not even remotely the same thing, which is why you edited your post, yet, you double down. :avatarquote
By Phlebas Go To PostPointing out the hypocrisy about the refugee ban and people finally giving it attention. Saw none of it when he did it.Ok. Explain why Trump's executive decision was similar. Is there a known security issue with the refugee status? Why are even people with a dual nationality and green cards banned from entering?
But sorry I didn't suck Obama's dick
This is not about sucking Obama's dick. Im not even American. Counter me with legit points, and I'll concede.

A: That refugee ban was fully vetted by appropriate parties in DHS and made exceptions for migrants inflight.
B: That ban was the direct result of an FBI case that showed a loophole in Refugee Vetting
C: The difference in magnitude of the Global Refugee Crisis in 2016 is simply staggering compared to what we had in 2011
D: That ban DID NOT EXTEND TO LEGAL PERMANENT RESIDENTS WITH VALID GREEN CARDS
Trump's plan was shoddily written and poorly thought out for the PRECISE purpose of inflicting maximum amount of pain and anguish upon refugees. Your false equivalency is a fucking joke.
Don't forget that they literally stated 9/11 for this ban yet none of the countries involved in 9/11 are banned.
Hint: he's got businesses in all those 9/11 countries

Anyway Phlebas, you didn't believe that the Russian hacks were a thing. What are your thoughts about it, seeing as the issue has gotten traction recently?
By FlutterPuffs Go To PostOk. Explain why Trump's executive decision was similar. Is there a known security issue with the refugee status? We don't know how through the process was.

Considering that story I linked, stories like the one of Waad Ramadan Alwan, who said he was fleeing persecution. In the end it was a cover story and he got in through the cracks.
Cases like that are likely the deciding factor on this, at least to me. A blanket ban till the process is scrutinized.
The preference to Christian refugees I'm not sure if he has the power on that, so I can't say for sure.
By FlutterPuffs Go To PostAnyway Phlebas, you didn't believe that the Russian hacks were a thing. If it's proven I'll change my tune but not enough known yet to make it 100% sure.

I agree with DY, in a way.
What Trump doing is appalling, but Americans are fighting back, they are protesting on the streets, and the papers have freedom to post about the travesty that's currently being unraveled.
There will have to be a lot of diplomatic discussions with other countries after this is over for sure, but I'm happy with what I'm seeing from the people :D
