In 2015, Roy Moore was performing his second stint as a justice sitting on the Alabama Supreme Court–Moore was previously removed from office for ignoring a federal court order mandating the removal of a Ten Commandments monument from the state judicial building.
The Alabama Supreme Court had the opportunity to hear the case of one Eric Lemont Higdon, a man accused and convicted of two sodomy charges due to sexual assault against a four-year-old at Mama’s Place Christian Academy in Clay, Alabama.
One of those convictions was first-degree sodomy of a child less than 12 years old. The other conviction was first-degree sodomy by forcible compulsion. Essentially, the first conviction was for statutory rape; the second for forcible rape.
Higdon’s conviction on the forcible rape charge was eventually overturned on appeal. The state, by way of prosecutor Luther Strange, appealed that decision and the Alabama Supreme Court took the case up for review.
Eight of the nine justices on the panel found that the appeals court had erred. Their legal logic was such that a 17-year-old’s sexual assault of a four-year-old was enough to produce in the mind of the four-year-old, an “implied threat of serious physical injury.” The decision was reversed and remanded and Higdon’s conviction was reinstated.
Roy Moore dissented from that opinion. He wrote:
Because there was no evidence in this case of an implied threat of serious physical injury…or of an implied threat of death, Higdon cannot be convicted of sodomy in the first degree “by forcible compulsion.”

The US Army has lifted an Obama-era ban on allowing people with a history of mental illness, self-mutilation and drug abuse to serve in the military, despite warnings from experts.
The Army issued a ban on waivers for mentally ill applicants in 2009 after an epidemic of suicides among troops, according to USA Today. But this ban is now being reversed, allowing individuals with depression, bipolar disorder and self-harm to join up.

Johnston said the suspect stole a white pickup and drove it through town, doing “several random drive-by shootings of residences” in the community of about 1,500 people west of Corning.
“We know of no real connection to any of the victims,” Johnston said. “Most of the victims in this case appear to be random selections.”
At one point, the shooter crashed into a gate at Rancho Tehama Elementary School, according to a parent who witnessed the attack. Stephanie Turner, who was dropping off her 6-year-old daughter and 7-year-old son, told The Sacramento Bee she saw the white pickup “rammed through the bus gate,” and then noticed a man stalking the school grounds.
“I thought there was a car accident,” Turner said. “I pulled into the school and heard gunshots. I told my kids to get down onto the floor. Then I saw a guy in the back of the school with a rifle. As soon as he saw us, he started shooting at us. I just took off.”
The gunman fired dozens of rounds into Rancho Tehama Elementary School.
“The gunman shot out windows and through walls,” the district said in a statement. “In addition to injuries from broken glass, a student on campus was wounded by gunfire.”
Johnston said the gunfire struck a young boy inside the school. The district said the boy’s condition was stable, but declined to release other details.
After leaving the school the suspect stole another car and began firing at officers when they raced to town to confront him. They returned fire and killed him at a nearby intersection. All told, the ordeal lasted around 45 minutes, Johnston said.
Police logs from the Red Bluff Daily News show Janson was arrested in February of this year on Bobcat Lane on charges of “assault with deadly weapon not firearm or force, great bodily injury likely, battery on person, crime against elder or dependent adult, discharge firearm with gross negligence and false imprisonment with violence.” The paper reports bail was set at $160,000.

The other partner of this equation is Tek, which is one of only two outsource firms that passed the rate decrease through to the contractors. On one hand, you know, that makes sense. On the other hand, I worked as a contractor for Tek for Wells Fargo in the past (and I am employed directly by Wells Fargo now), and I also knew how much Wells Fargo was paying them for my services, and therefore how much they were keeping. Everyone should be complaining about the repeal of the thing that prevents graduate students from having to accept their waived tuition as income. My sister would be ruined. She gets a 37k stipend to live in nyc, if they pass this she will be making only 15k and cant live on it. They cant work because they have to be in labs all day. Science is about to get destroyed if this tax bill passes. Its almost clever in how evil and how few people know about it.
