His continuing pattern of creating similar risks of repeated contact like that is evidence for why it should have netted him an ejection or subsequent suspension, not the other way around.

The flailing is natural to him, and that's key in determining intent.
The issue is not intent, but does Draymond have a history of doing a) the flailing b) flailing and hitting people. I just detailed the set precedent of Kobe Bryant's motion earlier, it takes the NBA multiple incidents to usually give a suspension.
The only reason your foot should be near someone's face is if you're dunking. There's something seriously wrong when one foot is on the ground and the other is at a players face because this isn't a karate competition.
