I don't think 1 out of 100 BMW models having faulty emissions is an indicator of them being fraudulent. What's making the VW actions news is that they were deliberate actions and VW admitted as much. This doesn't pass the sniff test.

BERLIN (Bloomberg) – German magazine Auto Bild said it has no indication that BMW Group manipulated emissions tests, clarifying its earlier report that an X3 SUV had produced emissions more than 11 times the European limit when road-tested by the International Council on Clean Transportation.
