The FTC needs to pick its battles better. They’re taking L after L . Appealing it would be another L. They had a horrible case and it showed. The EU regulators appear to be the only one who had any idea of what they were talking about. The CMA and FTC just saw “Big Tech” from the jump and had their mind made up to try and block it.

Even with this deal, Microsoft will be far from being at the top of industry and the top tier of Gamepass is still cheaper than the top tier of PS+ while offering much more.
Second, you can't say with a straight face that the FTC presented an excellent case.
They were more interested in protecting Sony than the customers.
I do agree there was some pretty egregious procedural shoddiness, and quoting the wrong legal test in your judgment is pretty poor too. Idk if absent those things the court would have come to a different conclusion, however.

The FTCs case was terrible top to bottom. Like laughably bad to the point one of their big arguments was what if Microsoft had the evil idea of releasing an exclusive Santa skin on CoD. That would surely tip sales towards them and kill Sony's.
Pretty much all of their talking points were Jimbo's doom and worst case scenarios, and how they would affect Sony specifically, including the hypothetical of making the PS5 version so technically broken to tank it. Never did they bother to show a bit if harm towards customers.

Dude was accusing the judge of lack of mental competency and personal bias (ie paid off) ffs, when pretty much all she did was see through all those idiotic arguments, like recognizing exclusive skins being everywhere in games, or how tipping the market scales is just how markets operate and not really enough to show harm anyway.
In the end, it's the same platform fanboy fantasy of crying monopoly of an industry that's pretty much impossible to monopolize. It shouldn't be this hard to show how it could be actually bad for customers. Increasing hardware prices for late adopters, constant rising of sub and boxed games prices at will, pretty much soft colluding with the rest of the big publishers to all do it at the same time, and cutthroat foreclosure of platform competitors through oceans of exclusive third party games, revenue deals, exclusive content and dlc are all real things.

the judge referred to GOW R as the 'Thor Game' or something.
I still find it funny that MS said they wouldn’t make COD exclusive because it would upset gamers and building a monolopy was the 2019 plan and everyone believed them. I mean I am no lawyer but seems like it should have been pressed a little more.

Kinda confused as to the architecture of Drake's Fang. Really quite weird how small the world feels. It's like in trying to prevent from giving you dozens of tiny areas, they've crammed everything into a few medium sized zones that just ends up making every landmark seem like it's a stone's throw from another. Lack of transitional scenes contributes massively as well, at least they tell you why and how you end up where you do this time around though.
