Surely some kind of independant body has to take a look at the contract and make a decision in order to break the stalemate one way or the other...

Yes the Spanish courts, which would take at least a year anyway in all likelihood. It's a big part of why he's fucked. He'd be barred from playing until the outcome of the case if he tried to unilaterally move in the meantime.
