How would that have gotten past a conservative SCOTUS? They may have had majorities over the years but that ignores the fact that the party itself is fragmented amongst different interest groups and constituencies and can’t agree on everything there is to agree about. Just like the Republicans at the moment can’t agree on killing Obamacare, a position they’ve trumpeted for almost a decade. That’s just the nature of your political system. You need 60 votes and bipartisan support to pass something comprehensive like this and even more if they tried to make a constitutional amendment.
